User Agreement:

1. By registering as a party planner or service provider, you acknowledge reading our How it Works page.
2. Users are required to enter demographic data such as name, address, telephone number and email address. This information is required for us to comply with the Federal CAN SPAM Act of 2003.
3. There is no charge to use our site for posting events for bids. Professional event vendors who wish to join PlanYourPartyOnline.com will be charged an annual membership fee and, if hired through our site, will be charged a nominal finders fee.
4. PlanYourPartyOnline.com has the right to remove any member at any time as circumstances warrant.
5. PlanYourPartyOnline.com is a web-based marketplace that directly connects event planners with vendors. We are not involved in the actual transaction between buyers and sellers. As such, we have no control over the quality, safety or legality of the services advertised, the accuracy of the listings, the ability of sellers to sell services or the ability of buyers to buy services. We cannot ensure that a transaction will be completed.
6. In the event of a dispute with a PlanYourPartyOnline.com member or user, you agree to release PlanYourPartyOnline.com, its officers, directors, agents, subsidiaries, joint ventures and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
7. PlanYourPartyOnline.com does not control the information provided by members or users and available through our system. Please use caution and common sense when using the site. By using this site, you agree to accept certain risks and that PlanYourPartyOnline.com is not responsible for the acts or omissions of site members and users.
8. PlanYourPartyOnline.com may suspend or terminate your account and/or membership if we suspect that you have engaged in fraudulent activity, misrepresentation or deceptive practices in connection with the site.
9. Feedback on PlanYourPartyOnline.com consists of comments left by users and members and is published on the site at our discretion. PlanYourPartyOnline.com has the right to remove or edit feedback that is considered to be libelous, slanderous, threatening or offensive.
10. PlanYourPartyOnline.com shall not under any circumstance be liable for any direct, indirect, special, incidental or consequential damages, including but not limited to loss or profit arising from the use of or inability to use the site.
11. You agree to indemnify and hold PlanYourPartyOnline.com, our parent, subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorneys’ fees made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
12. You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of PlanYourPartyOnline.com’s services; the bidding on, listing, purchase, solicitation of offers to purchase; and the sale of professional services and other related items.
13. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
14. Except as explicitly stated otherwise, any notices shall be given by postal mail or to the email address you provide during the registration process. In the case of email notification, notice shall be deemed given 24 hours after the email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address you provided during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.
15. Any legal controversy or claim arising from or relating to this Agreement or our services, excluding legal action taken by PlanYourPartyOnline.com to collect our fees and/or recover damages for or obtain an injunction relating to our site operations, intellectual property and services, shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in New York, New York, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either party may seek any interim or preliminary relief from a court of competent jurisdiction in New York, NY necessary to protect the rights or property of you or us pending the completion of arbitration. Should either party file an action contrary to this provision, the other party may recover attorney’s fees and costs up to $1,000.
16. The services hereunder are offered by PlanYourPartyOnline.com, located at PO Box 498, New York, NY 10037. If you are a New York resident, you may have this same information emailed to you by sending a letter to the foregoing address with your email address and a request for this information.
17. We reserve the right to modify or cancel any posted event.
18. We reserve the right to suspend a member's account for unacceptable activity.

Privacy Policy:

1. For each visitor to our website, our server collects no information regarding the domain or email address unless the visitor voluntarily types it into one of our forms
2. Our site collects information volunteered by the user, such as survey information, feedback and/or site registration.
3. All data collected is used to communicate important information regarding activity of a bidding event process, updates made to our site or about related services.
4. We do not share information with any ad server organizations.
5. We will never give, sell or otherwise provide subscriber data to anyone, period.
6. Should we share aggregated demographic information with partners and/or advertisers, such information will not be linked to personal information that identifies individual members.
7. We use cookies to track visitors on our site to better understand what areas of our website best serves our users. Should PlanYourPartyOnline.com allow advertisers on our site, they may use cookies; PlanYourPartyOnline.com will have no access to or control over these cookies.

9. We use industry standard technologies when transferring and receiving consumer data exchanged on our website, and we take every precaution to protect registered member information.
10. PlanYourPartyOnline.com logs IP addresses for system administration purposes, including diagnosing server issues, monitoring traffic patterns, analyzing trends, administering the site, tracking member user patterns and identifying the most popular areas of the site. IP addresses are not linked to personally identifiable information and are only used to gather broad demographic information for aggregate use, except in the case of fraud.
11. PlanYourPartyOnline.com contains links to other websites and is not responsible for the privacy practices of such websites. This privacy statement applies solely to information collected by us.
